Admission Contracts And Agreements - Dear Provider Letters Issued

DSHS/ADSA has just released ALF # 2012-007, NH # 2012-004 and AFH #2012-008, reminding providers of the Residents Rights statute's requirements regarding admission agreements.

Some basic facts about chapter 70.129 RCW requirements include:

• The Department has the authority and responsibility to review any admission contract or agreements to determine if they meet the relevant statutes.
• The resident rights statute does not require the applicant/provider to have admission contracts or agreements.
• If applicants/ providers choose to have an admission contract or agreement, chapter 70.129 RCW does require that the documents meet all of the requirements of the chapter.
• Whether or not there is an admission contract or agreement, the applicant/provider still has to provide to residents with all of the notices and policies required throughout chapter 70.129 RCW, in writing and in language the resident understands.
